1) الشروط والأحكام

أولاً: مقدمة

يمثل هذا المستند الشروط والأحكام التي تحكم استخدامك لموقع "عدس هوم ستورز" الإلكتروني (ويُشار إليه فيما بعد بـ"الموقع" أو "الشركة")، والمتخصص في بيع الأثاث والمراتب والمفروشات المنزلية داخل جمهورية مصر العربية. بمجرد دخولك للموقع أو استخدامه أو إتمام أي عملية شراء، فإنك تُقر بموافقتك الكاملة على هذه الشروط.

ثانياً: نطاق الاستخدام

1. يُسمح باستخدام الموقع للأغراض الشخصية والشرعية فقط، ويُحظر استخدامه في أي نشاط مخالف للقانون المصري.
2. يحق للشركة تعديل محتوى الموقع أو إيقافه مؤقتاً أو نهائياً دون إشعار مسبق، مع بذل الجهد لإبلاغ العملاء بأي تغييرات جوهرية تؤثر على طلباتهم القائمة.
3. يلتزم المستخدم بتقديم بيانات صحيحة ودقيقة (الاسم، رقم الهاتف، العنوان) عند تسجيل الحساب أو إتمام الطلب، وتتحمل الشركة عدم مسؤوليتها عن أي تأخير أو خطأ في التوصيل ناتج عن بيانات غير صحيحة.

ثالثاً: المنتجات والأسعار

1. تُعرض أسعار المنتجات على الموقع بالعملة المصرية.
2. تحتفظ الشركة بحقها في تعديل الأسعار أو العروض في أي وقت دون إشعار مسبق، على ألا يؤثر ذلك على الطلبات المؤكدة فعلياً بسعر سابق.
3. تُبذل الشركة أقصى جهد لعرض صور ومواصفات دقيقة للمنتجات (المقاسات، الخامات، الألوان)، مع الإقرار بوجود فروق طفيفة محتملة في درجات اللون بين الصورة المعروضة والمنتج الفعلي نتيجة اختلاف شاشات العرض أو الإضاءة عند التصوير.
4. في حال نفاد أي منتج بعد تأكيد الطلب، يتم إبلاغ العميل فوراً مع تقديم بديل مناسب أو استرداد كامل المبلغ المدفوع.

رابعاً: الطلب والتعاقد

1. يُعتبر الطلب نهائياً بعد تأكيده من قبل الشركة عبر مكالمة هاتفية أو رسالة تأكيد (SMS/واتساب/بريد إلكتروني).
2. يحق للشركة إلغاء أي طلب في حال الاشتباه في غش أو بيانات وهمية أو تكرار الطلبات دون جدية الشراء، مع إخطار العميل بالسبب.

خامساً: طرق الدفع

1. الدفع الإلكتروني (أونلاين) عبر وسائل الدفع المتاحة على الموقع (بطاقات ائتمان/خصم، محافظ إلكترونية، أو غيرها من الوسائل المعتمدة).
2. الدفع نقداً عند الاستلام (Cash on Delivery)، ويحق للشركة تحديد حد أقصى لقيمة الطلبات المتاحة لهذه الخدمة أو استثناء بعض المناطق منها حسب سياسة الشحن المعمول بها.
3. جميع معاملات الدفع الإلكتروني تتم عبر بوابات دفع آمنة ومعتمدة، ولا تقوم الشركة بتخزين بيانات البطاقات البنكية للعملاء.

سادساً: الشحن والتسليم والاسترجاع

تخضع عمليات الشحن والتسليم والاسترجاع والاستبدال للسياسات المنفصلة الموضحة في هذا المستند ("سياسة الشحن" و"سياسة الاسترجاع")، وتُعد جزءاً لا يتجزأ من هذه الشروط.

سابعاً: الضمان

1. تخضع المنتجات (الأثاث والمراتب) لضمان ضد عيوب الصناعة فقط، وتُحدَّد مدة الضمان وتفاصيله في فاتورة/بطاقة الضمان المرفقة مع كل منتج عند التسليم.
2. لا يشمل الضمان التلف الناتج عن سوء الاستخدام، أو الاستخدام التجاري غير المنزلي، أو التعديلات التي يجريها العميل بنفسه، أو التلف الناتج عن عوامل خارجية (حريق، سوائل، حشرات، رطوبة).

ثامناً: الملكية الفكرية

جميع المحتويات المعروضة على الموقع (شعارات، صور، تصميمات، نصوص) هي ملك حصري لشركة عدس هوم ستورز، ويُحظر إعادة استخدامها أو نسخها دون إذن كتابي مسبق.

تاسعاً: حدود المسؤولية

لا تتحمل الشركة مسؤولية أي أضرار غير مباشرة تنتج عن استخدام المنتج بالمخالفة لتعليمات الاستخدام أو الصيانة المرفقة.

عاشراً: القانون الحاكم وتسوية المنازعات

تخضع هذه الشروط لأحكام القوانين المصرية النافذة، وعلى رأسها قانون حماية المستهلك رقم 181 لسنة 2018 ولائحته التنفيذية. وفي حال نشوء أي نزاع، تكون محاكم جمهورية مصر العربية المختصة هي صاحبة الاختصاص القضائي، مع أحقية العميل في اللجوء إلى جهاز حماية المستهلك.

حادي عشر: التعديلات

تحتفظ الشركة بحق تعديل هذه الشروط في أي وقت، ويُعمل بالنسخة المحدثة فور نشرها على الموقع.

1. Introduction

These Terms & Conditions govern your use of the Adas Home Stores website ("the Website" / "the Company"), which sells furniture, mattresses, and home furnishings within the Arab Republic of Egypt. By accessing the Website or placing an order, you agree to be fully bound by these terms.

2. Scope of Use

1. The Website may be used only for lawful, personal purposes; any use that violates Egyptian law is prohibited.
2. The Company may modify or suspend the Website, in whole or in part, at any time without prior notice, while making reasonable efforts to inform customers of any material changes affecting active orders.
3. Users must provide accurate information (name, phone number, address) when registering or placing an order. The Company is not liable for delivery delays or errors resulting from inaccurate customer data.

3. Products and Pricing

1. Prices are displayed in Egyptian Pounds (EGP) and include VAT unless stated otherwise.
2. The Company reserves the right to change prices or promotions at any time without prior notice; this will not affect orders already confirmed at a previous price.
3. The Company makes every reasonable effort to display accurate product images and specifications (dimensions, materials, colors), while acknowledging slight color variations may occur due to display screen or lighting differences.
4. If a product becomes unavailable after order confirmation, the customer will be notified immediately and offered a suitable alternative or a full refund.

4. Orders and Contract Formation

1. An order is considered final once confirmed by the Company via phone call or confirmation message (SMS/WhatsApp/email).
2. The Company reserves the right to cancel any order suspected of fraud, false information, or repeated non-serious ordering, with notice to the customer of the reason.

5. Payment Methods

1. Online payment via the payment methods available on the Website (credit/debit cards, e-wallets, or other approved methods).
2. Cash on Delivery (COD), subject to a maximum order value limit and/or exclusion of certain areas, as defined under the Shipping Policy.
3. All online payment transactions are processed through secure, licensed payment gateways; the Company does not store customers' bank card details.

6. Shipping, Delivery & Returns

Shipping, delivery, returns, and exchanges are governed by the separate policies set out in this document ("Shipping Policy" and "Refund & Return Policy"), which form an integral part of these Terms.

7. Warranty

1. Products (furniture and mattresses) carry a manufacturing-defect warranty only; the warranty period and terms are specified on the invoice/warranty card provided with each product upon delivery.
2. The warranty does not cover damage resulting from misuse, non-residential/commercial use, customer-made modifications, or damage from external factors (fire, liquids, pests, humidity).

8. Intellectual Property

All content on the Website (logos, images, designs, text) is the exclusive property of Adas Home Stores. Reproduction or reuse without prior written permission is prohibited.

9. Limitation of Liability

The Company is not liable for indirect damages arising from product use contrary to the enclosed usage or maintenance instructions.

10. Governing Law & Dispute Resolution

These Terms are governed by applicable Egyptian law, including Consumer Protection Law No. 181 of 2018 and its executive regulations. Any dispute shall fall under the jurisdiction of the competent Egyptian courts, without prejudice to the customer's right to file a complaint with the Consumer Protection Agency.

11. Amendments

The Company reserves the right to amend these Terms at any time; the updated version takes effect immediately upon publication on the Website.
